CK Hutchison Holdings Limited has launched international arbitration proceedings against the Republic of Panama, alleging the country violated relevant investment protection treaties.
The dispute stems from the takeover of port assets operated by the group in Panama. CK Hutchison stated that Panama’s relevant administrative measures infringed the group’s legitimate investment rights and interests, conflicting with obligations under bilateral and multilateral investment protection agreements.
Under the framework of international investment arbitration, the case will be heard by an independent arbitral tribunal. The tribunal will assess whether Panama breached treaty commitments and determine appropriate remedies, which may include compensation for losses suffered by the investor.
Industry observers note that this investment treaty arbitration differs from ordinary commercial dispute arbitration. It allows foreign investors to bring claims directly against a sovereign state, representing a key cross-border legal remedy for large-scale overseas infrastructure investments.
CK Hutchison has reserved all legal rights in this matter and will pursue full compensation for damages through arbitration. Panama authorities have not yet issued an official response to the arbitration filing as of press time.
